Elon Musk has lost a high-profile lawsuit against OpenAI and Microsoft, marking a major legal setback in a dispute that has become symbolic of the broader power struggle within the artificial intelligence industry.

According to U.S. media reports on May 18, a federal jury in California ruled against Musk in his case targeting OpenAI CEO Sam Altman, co-founder Greg Brockman, OpenAI, and Microsoft. Musk immediately signaled plans to appeal the decision.

The lawsuit centered on OpenAI’s transformation from a nonprofit research organization into a company with increasingly commercial operations and large-scale corporate partnerships. Musk, one of OpenAI’s original co-founders, had argued that the organization abandoned its founding mission of developing AI for the public good.

Musk’s legal team also claimed that OpenAI and Microsoft generated enormous financial gains through exclusive AI partnerships and investment structures that allegedly conflicted with the company’s original principles.

OpenAI countered that Musk had long been aware of the company’s operational direction and that much of his legal argument fell outside the statute of limitations. The jury ultimately sided with OpenAI’s position, concluding that the claims were filed too late to proceed.

Legal analysts in Silicon Valley say the case extends beyond a simple corporate dispute and reflects intensifying competition over leadership in the generative AI market. Musk has recently expanded his own AI ambitions through xAI, placing him in direct competition with OpenAI in the race to dominate advanced AI technologies.

The ruling is expected to ease some of the legal uncertainty surrounding OpenAI as the company continues pursuing large-scale investments, organizational restructuring, and potential long-term public market ambitions. Microsoft also appears to have avoided a potentially damaging legal complication tied to its multibillion-dollar partnership with OpenAI.

During the trial, testimony from Silicon Valley figures and internal discussions from OpenAI’s early formation period attracted widespread attention. Debates surrounding AI governance, nonprofit structures, public-interest obligations, and commercialization strategies resurfaced throughout the proceedings.

Industry observers say the case highlights a growing tension across the AI sector as companies originally founded with public research goals increasingly become tied to major corporate capital and aggressive commercialization strategies.

Following the verdict, Musk reiterated on social media that the core issue remains “who changed the organization’s direction and when,” reaffirming his intention to challenge the ruling through the appeals process. OpenAI, meanwhile, described the verdict as validation of the legitimacy of its operational structure.

Experts say the appeals process could once again place OpenAI’s early governance agreements and interpretations of its nonprofit principles under legal scrutiny.

One AI industry executive described the lawsuit as “a symbolic case that goes beyond a civil dispute and reflects the larger debate over governance, commercialization, and public responsibility in the generative AI industry.”
